"Kalau bilik asmara itu tidak ada regulasinya. Masih wacana belum tahap realisasi, perlu regulasi, dukungan semua pihak, jangan sampai jadi polemik," ujar Ade saat dihubungi kumparan, Sabtu (8/12).



Ade menyebut, saat ini Ditjen PAS masih memprioritaskan untuk menuntaskan masalah over kapasitas, pemberantasan narkoba, dan pencegahan radikalisme di lapas. Sebab apabila pemerintah memfasilitasi bilik asmara, maka bisa mengurangi jumlah ruangan di lapas untuk menampung napi.

Memang, kata Ade, narapidana merupakan manusia biasa yang memiliki kebutuhan biologis untuk berhubungan suami-istri. Meski sebagai napi ia tahu konsekuensi kemerdekaannya hilang.

"Ada juga yang melakukan hubungan lawan jenis tapi di luar prosedur dan ada yang melakukan kekerasan dan kabur ke luar lapas untuk memenuhi kebutuhan itu," imbuhnya.


Meski belum ada aturan soal bilik asmara, Kemenkumham telah membentuk aturan sebagai solusi bagi para napi untuk untuk menyalurkan hasrat seksualnya yakni dengan Cuti Mengunjungi Keluarga (CMK).

Aturan itu termaktub dalam Peraturan Menteri Hukum dan HAM Nomor 3 Tahun 2018 tentang Syarat dan Tata Cara Pemberian Remisi, Asimilasi, Cuti Mengunjungi Keluarga, Pembebasan Bersyarat, Cuti Menjelang Bebas dan Cuti Bersyarat.


Melalui aturan tersebut, napi diberikan kesempatan untuk bertemu keluarganya maksimal 2x24 jam. Waktu tersebut, kata Ade, bisa digunakan napi untuk memenuhi kebutuhan biologis mereka.


Akan tetapi dalam pemberian cuti tersebut, napi harus memenuhi beberapa syarat. Selain itu CMK tidak diberikan kepada napi yang tindak pidananya masuk kategori kejahatan luar biasa seperti korupsi, narkoba, dan terorisme.


"Untuk memenuhi supaya dia tidak menyimpang ada regulasi tapi harus dipenuhi oleh si napi tersebut, ada syarat yang harus dipenuhi, biasanya dengan program cuti mengunjungi keluarga," ucapnya.


Berikut syarat untuk mendapatkan CMK seperti tertuang dalam Permenkum HAM Nomor 3 Tahun 2018:


Pasal 67


Cuti Mengunjungi Keluarga dapat diberikan kepada narapidana yang memenuhi syarat:


a. berkelakuan baik dan tidak pernah melakukan pelanggaran tata tertib dalam tahun berjalan;


b. masa pidana paling singkat 12 bulan bagi narapidana;


c. tidak terlibat perkara lain yang dijelaskan dalam surat keterangan dari pihak Kejaksaan Negeri setempat;


d. telah menjalani 1/2 dari masa pidananya bagi narapidana;


e. ada permintaan dari salah satu pihak keluarga yang harus diketahui oleh ketua rukun tetangga dan lurah


atau kepala desa setempat;


f. ada jaminan keamanan dari pihak keluarga termasuk jaminan tidak akan melarikan diri yang diketahui oleh ketua rukun tetangga dan lurah atau kepala desa setempat atau nama lainnya; dan


g. telah layak untuk diberikan izin Cuti Mengunjungi Keluarga berdasarkan pertimbangan yang diberikan oleh tim pengamat pemasyarakatan atas dasar laporan penelitian kemasyarakatan dari Bapas setempat, tentang pihak keluarga yang akan menerima narapidana, keadaan lingkungan masyarakat sekitarnya, dan pihak lain yang ada hubungannya dengan narapidana yang bersangkutan.

Ayat 1


Cuti Mengunjungi Keluarga tidak dapat diberikan kepada:


a. Narapidana yang melakukan tindak pidana terorisme, narkotika dan prekursor narkotika, psikotropika, korupsi, kejahatan terhadap keamanan negara dan kejahatan hak asasi manusia yang berat, serta kejahatan transnasional terorganisasi lainnya;


b. Terpidana mati;


c. Narapidana yang dipidana hukuman seumur hidup;


d. Narapidana yang terancam jiwanya; atau


e. Narapidana yang diperkirakan akan mengulangi tindak pidana.
